The Board considers applications made by offenders under section 33(1) of the Parole Act 2002 as it was in force before 1 October 2007 for front-end home detention. From 1 October 2007 home detention is no longer an option for the Board, which now only considers “transitional” cases.
The figures provided below (with the exception of those for 2002-03) distinguish between applications made by offenders already in custody and those made by offenders who have had the start of their sentence of imprisonment deferred by a sentencing court.
The Board has a discretion (now only for transitional cases) to release an offender in all home detention cases as long as it is satisfied on reasonable grounds that the offender will not pose an undue risk to the safety of the community or any person or class of persons if he or she is detained on home detention rather than in a prison.

The Board has a discretion (now only for transitional cases) to revoke an order for release on home detention either before or after the offender is released but may only do so after release if the offender applies to the Board to be returned to prison.
