The Department of Corrections may apply to the Board to have an offender recalled to continue serving their sentence in prison on the following grounds (in summary):
- The offender poses an undue risk to the safety of the community or any person or class of persons.
- The offender has breached his or her release conditions or detention conditions (transitional cases).
- The offender has committed an offence punishable by imprisonment, whether or not this has resulted in a conviction.
In the case of an offender who is subject to residential restrictions or to home detention (transitional cases):
- the offender is jeopardising the safety of any person at his or her residence.
- A suitable residence in the area where a home detention scheme is operated is no longer available (transitional cases).
In the case of an offender who is subject to a special condition requiring their attendance at a residential programme:
- The offender is jeopardising the safety of any person at the residence, or the order or security of the residence.
- The offender has left the residence early.
- The programme has ceased to operate, or the offender’s participation in it has been terminated.
In the case of an offender who is subject to residential restrictions:
- The offender no longer wishes to be subject to residential restrictions.
As from 1 October 2007
the Commissioner of Police may apply to the Board to have an offender recalled to continue serving their sentence in prison on the ground that the offender poses an undue risk to the safety of the community or any person or class of persons.
