Release on conditions (non-discretionary releases)

These are cases where the Board has no discretion to release an offender.  The offender must by law be released, and the Board’s only role is to set the conditions of the offender’s release. 

The figures below include two types of release:

  • offenders who are released at their statutory release dates under the Parole Act 2002, and
  • offenders who were sentenced under the Criminal Justice Act 1985 and must be released at their final release dates (unless an order under section 107 of the Parole Act to keep the offender in prison past that date has either been made or applied for).
