In some cases, offenders need to apply for a hearing before the Board.
Early Referral. If an offender who has not reached their parole eligibility date feels their situation has changed and they believe a parole hearing is warranted earlier than is scheduled, they can apply to the Board for an early referral. Under section 25 of the Parole Act 2002, they must cite "exceptional circumstances", with the Chairperson having the discretion to grant a hearing.
An offender who has reached their parole eligibility date may apply to the Board under section 26 of the Parole Act 2002 to be considered for release on parole earlier than when they are due to be considered for release on parole.
Compassionate Release. If an offender is due to give birth or is suffering from a terminal illness, they may apply to the Board for compassionate release. If granted compassionate release, an offender will be given release conditions and may be recalled to prison if these conditions are not followed.
Review. An offender may apply in writing for the Board to review its decision on their case, but must do so in writing within 28 days of the decision.
